AGB für die Vermietung von Suiten bei Villa Cultraro ́s

1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Mietverhältnisse zwischen dem Vermieter und dem Mieter im Zusammenhang mit der Buchung und Nutzung der angebotenen Suiten. Mit der Buchung erkennt der Mieter diese AGB an.

2. Vertragsabschluss und Zahlungsbedingungen

(1) Die Buchung einer Suite erfolgt schriftlich, elektronisch oder telefonisch. (2) Eine Anzahlung in Höhe von 30 % des Gesamtbetrags ist bei Buchung erforderlich. (3) Die Buchung wird erst mit der schriftlichen Buchungsbestätigung durch den Vermieter und dem Eingang der Anzahlung auf das angegebene Konto verbindlich. (4) Der restliche Mietbetrag ist spätestens 6 Wochen vor Anreise fällig, sofern nicht anders vereinbart.

3. Stornierungsbedingungen

(1) Der Mieter kann die Buchung unter folgenden Bedingungen stornieren:

  • Bis vier Wochen vor Ankunft: 40 % des Gesamtbetrags werden berechnet.
  • Bis drei Wochen vor Ankunft: 30 % des Gesamtbetrags werden berechnet.
  • Bis zwei Wochen vor Ankunft: 20 % des Gesamtbetrags werden berechnet.
  • Ab einer Woche vor Ankunft: Keine Erstattung mehr möglich.(2) Eine Stornierung hat schriftlich zu erfolgen.
    (3) Falls die Stornierung seitens des Vermieters erfolgt, wird der volle bereits geleistete Betrag auf das bekannte Konto des Mieters zurückerstattet.4. Nutzung der Suite(1) Die gemietete Suite darf nur von der in der Buchung angegebenen Anzahl an Personen genutzt werden.
    (2) Die Suite ist sorgfältig zu behandeln und nach Ablauf der Mietdauer in ordnungsgemäßem Zustand zu hinterlassen.(3) Der Mieter haftet für von ihm verursachte Schäden an der Unterkunft oder deren Inventar.5. HaustiereDas Areal ist für Tiere nicht geeignet, da keine entsprechenden Einrichtungen oder gesicherten Bereiche vorhanden sind. Das Mitbringen von Haustieren ist daher nicht gestattet.

    6. Haftung des Vermieters

    (1) Der Vermieter haftet nicht für persönliche Gegenstände des Mieters, die während des Aufenthalts verloren gehen oder beschädigt werden.
    (2) Eine Haftung für durch höhere Gewalt oder andere nicht vorhersehbare Ereignisse verursachte Schäden ist ausgeschlossen.

    7. Schlussbestimmungen

    (1) Es gilt das Recht der Republik Italien. (2) Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, bleibt die Gültigkeit der übrigen Bestimmungen unberührt. (3) Erfüllungsort und Gerichtsstand ist, soweit gesetzlich zulässig, der Sitz des Vermieters.

1. Scope of Application

These Terms and Conditions (T&C) apply to all rental agreements between the landlord and the tenant in connection with the booking and use of the offered suites. By booking, the tenant acknowledges these T&C.

2. Conclusion of Contract and Payment Terms

(1) The booking of a suite is made in writing, electronically, or by telephone.
(2) A deposit of 30% of the total amount is required at the time of booking.
(3) The booking becomes binding only after the landlord’s written confirmation and receipt of the deposit in the specified account.
(4) The remaining rental amount is due no later than 6 weeks before arrival, unless otherwise agreed.

3. Cancellation Policy

(1) The tenant may cancel the booking under the following conditions:

• Up to four weeks before arrival: 40% of the total amount will be charged. • Up to three weeks before arrival: 30% of the total amount will be charged. • Up to two weeks before arrival: 20% of the total amount will be charged. • From one week before arrival: No refund possible.

(2) Cancellations must be made in writing.
(3) If the cancellation is made by the landlord, the full amount already paid will be refunded to the tenant’s known account.

4. Use of the Suite

(1) The rented suite may only be used by the number of persons specified in the booking.
(2) The suite must be handled with care and left in proper condition at the end of the rental period. (3) The tenant is liable for any damages to the accommodation or its inventory caused by them.

5. Pets

The premises are not suitable for animals, as there are no appropriate facilities or secured areas. Therefore, pets are not allowed.

6. Landlord’s Liability

(1) The landlord is not liable for the tenant’s personal belongings that are lost or damaged during the stay.
(2) Liability for damages caused by force majeure or other unforeseeable events is excluded.

7. Final Provisions

(1) The law of the Republic of Italy applies.
(2) Should any provision of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.
(3) The place of performance and jurisdiction, to the extent legally permissible, is the registered office of the landlord.

1. Ambito di Applicazione

Le presenti Condizioni Generali di Contratto (CGC) si applicano a tutti i rapporti di locazione tra il locatore e il conduttore in relazione alla prenotazione e all’uso delle suite offerte. Con la prenotazione, il conduttore accetta le presenti CGC.

2. Conclusione del Contratto e Condizioni di Pagamento

(1) La prenotazione di una suite avviene per iscritto, elettronicamente o per telefono.
(2) È richiesto un acconto del 30% dell’importo totale al momento della prenotazione.
(3) La prenotazione diventa vincolante solo dopo la conferma scritta del locatore e la ricezione dell’acconto sul conto specificato.
(4) L’importo residuo dell’affitto deve essere versato entro e non oltre 6 settimane prima dell’arrivo, se non diversamente concordato.

3. Politica di Cancellazione

(1) Il conduttore può cancellare la prenotazione alle seguenti condizioni:

  • Fino a quattro settimane prima dell’arrivo: verrà addebitato il 40% dell’importo totale.
  • Fino a tre settimane prima dell’arrivo: verrà addebitato il 30% dell’importo totale.
  • Fino a due settimane prima dell’arrivo: verrà addebitato il 20% dell’importo totale.
  • A partire da una settimana prima dell’arrivo: nessun rimborso possibile.(2) La cancellazione deve essere effettuata per iscritto.
    (3) Se la cancellazione avviene da parte del locatore, l’importo già versato sarà interamente rimborsato sul conto noto del conduttore.4. Uso della Suite(1) La suite affittata può essere utilizzata solo dal numero di persone specificato nella prenotazione. (2) La suite deve essere trattata con cura e lasciata in condizioni adeguate al termine del periodo di locazione.
    (3) Il conduttore è responsabile per eventuali danni causati all’alloggio o al suo inventario.5. Animali DomesticiL’area non è adatta agli animali, in quanto non dispone di strutture adeguate o di aree sicure. Pertanto, non è consentito portare animali domestici.6. Responsabilità del Locatore

    (1) Il locatore non è responsabile per gli oggetti personali del conduttore che vengano persi o danneggiati durante il soggiorno.
    (2) È esclusa qualsiasi responsabilità per danni causati da forza maggiore o altri eventi imprevedibili.

    7. Disposizioni Finali

    (1) Si applica la legge della Repubblica Italiana.
    (2) Qualora una qualsiasi disposizione delle presenti CGC sia o diventi invalida, la validità delle restanti disposizioni rimarrà inalterata.
    (3) Il luogo di adempimento e il foro competente, nella misura consentita dalla legge, è la sede del locatore.
